The primary legislation governing divorce for non-Muslims in Malaysia is the Law Reform (Marriage and Divorce) Act 1976 (Act 164), which sets out the procedures, grounds, and requirements for dissolving a marriage in the civil courts.
Two Types of Divorce in Malaysia
Under the LRA 1976, there are two main pathways to divorce:
1. Divorce by Mutual Consent (Joint Petition)
When both spouses agree to the divorce and have settled all ancillary matters — custody, maintenance, and division of matrimonial assets — they can file a joint petition under Section 52 of the LRA 1976. This is the faster and less contentious route. The couple files a single petition together, and the court typically grants the decree nisi within a few hearings. There is no requirement to prove fault or demonstrate that the marriage has broken down irretrievably beyond the mutual agreement itself.
A joint petition divorce in the Johor Bahru High Court can often be completed within 3 to 6 months from filing, provided all documents are in order and both parties attend the hearings.
2. Contested Divorce (Single Petition)
When one spouse files for divorce without the other's agreement, the process is more involved. Under Section 53 of the LRA 1976, the petitioner must prove that the marriage has broken down irretrievably by establishing one or more of the following grounds:
- The other spouse has committed adultery
- The other spouse has behaved in such a way that the petitioner cannot reasonably be expected to live with them
- The other spouse has deserted for a continuous period of at least two years
- The parties have lived apart for a continuous period of at least two years
Before filing a single petition, the law requires the petitioner to attend compulsory conciliation at the Jabatan Pendaftaran Negara (JPN), unless an exemption applies. A certificate from JPN confirming that reconciliation was attempted but failed must accompany the petition.
The Divorce Process: Stage by Stage
Filing the Petition
The petition is filed at the High Court in Johor Bahru, along with supporting affidavits, the marriage certificate, and other relevant documents. For a single petition, the court fee and filing requirements are more extensive.
Service on the Respondent
In a contested divorce, the petition must be formally served on the respondent, who then has a set period to file a reply or appearance. If the respondent fails to respond, the petitioner may apply for a default judgment.
Decree Nisi
If the court is satisfied that the grounds for divorce have been established, it will grant a decree nisi. This is a provisional order that does not immediately dissolve the marriage. The court will also deal with ancillary matters — custody of children, maintenance, and division of property — either at this stage or shortly after.
Decree Absolute
The decree nisi becomes absolute after a mandatory waiting period, typically three months. Only after the decree absolute is issued is the marriage formally dissolved. Both parties are then free to remarry.
Timelines and What Affects Them
A mutual consent divorce can conclude in as little as three months. A contested divorce, depending on the complexity of disputes over children or assets, may take anywhere from 12 to 24 months or longer. Delays can arise from contested ancillary reliefs, difficulties in serving papers, or adjournments due to court schedules in Johor Bahru.
